Plaintiff sued the City, alleging its adult employee sexually abused her while she was a 16-year-old intern at Cabrillo. CITY OF LOS ANGELES LOS ANGELES SUPERIOR COURT CASE NO. 19STCV45459 - A woman was reportedly run over and injured by a police vehicle while sunbathing at Venice Beach on Easter Sunday. The collision was reported just after 2:10 p.m. along the 1000 block of Ocean Front Walk. Similar incidents have occurred in the past. LAPD said it does not have an alert system or broadcast system to warn people when cruisers are patrolling on the beach.

BC 702166- Plaintiffs Tyler Shear, Tanner Shear, and Alexandria Shear (“Plaintiffs”) allege that Damon Shear (the “Decedent”) was a pedestrian at the intersection of Pacific Avenue and Sunset Avenue within the City of Los Angeles when he was struck and killed by a vehicle driven by Yvon Chausseblanche. (Trellis.Law) The intersection has been the scene of serious collisions previously, and in recent years the City of Los Angeles has increased LAPD presence there to target unsafe driving behaviors around this intersection, and LADOT has installed “paddles” in the crosswalk to alert drivers to the presence of pedestrians crossing, and has updated markings approaching the crosswalk so they are more visible. Additionally, to help pedestrians cross more safely, the City applied for and Caltrans awarded federal money to add flashing beacons and ADA-compliant access ramps at the intersection — but Caltrans has yet to actually give the money to LADOT. (The money is part of a master grant for several dozen intersections citywide, many with extensive federal requirements, including environmental clearances and additional levels of review, and Caltrans will not award the money until it has reviewed, approved and cleared all 36 projects.)

3/25/2022This action arises out of Plaintiff, Emanuel Brown (“Plaintiff”)’s employment with Los Angeles Fire Department (“LAFD”). Plaintiff alleges that he joined the LAFD in September 2008 and was assigned to Fire Station 21 (“FS 21”) as a Firefighter and Paramedic, receiving numerous positive performance evaluations and other commendations. Further, Plaintiff, who is African American, alleges that he began experiencing race-based discrimination, harassment and retaliation beginning in or around April 19, 2017, when he found fecal matter inside the driver-side compartment of his ambulance. (the “Feces Incident”) Thereafter, Plaintiff alleges that he began speaking to various members of his crew and to his Captain to investigate and report the event. Further, Plaintiff alleges that in February 2018, he spoke to the Los Angeles Times about the incident and received discriminatory treatment from colleagues as a result. Finally, Plaintiff alleges that he was forced to request a transfer to FS 94 to escape the allegedly discriminatory conduct, losing out on bonus pay and suffering other damages because of the transfer and his colleagues’ harassing conduct.

3/25/2022MATTHEW ALLEN HAUGLE JR., ET AL. v. CITY OF LOS ANGELES LOS ANGELES SUPERIOR COURT CASE NO. BC709005- On June 5, 2018, Plaintiffs Matthew Allen Haugle, Jr. (“MAH”), Matthew Haugle (“MH”), and Stephanie Haugle (“SH”) (collectively, “Plaintiffs”) filed this action against Defendant City of Los Angeles (“City”) for negligence/gross negligence arising out of emergency paramedic services provided on August 26, 2017. Plaintiffs allege that on August 26, 2017, when SH was approximately 35 weeks into her pregnancy, she awoke at approximately 4 a.m. with severe abdominal pain, sweating, and weakness. Plaintiffs called the Los Angeles City Fire Department paramedics who responded to the location, but refused to transport SH to the hospital. Plaintiffs allege the paramedics stated SH did not need to go to the hospital because she was not bleeding and stated that SH was too fat for them to carry down the flight of stairs from her apartment to the street. They told SH and family to drive themselves to the hospital if SH started bleeding and then left. Approximately 60 minutes later, SH began bleeding. Plaintiffs called paramedics again and a different team (except for one person who was in the first paramedics team) immediately transported SH to the hospital. Plaintiffs allege that the delay in performing a C-Section caused severe brain damage to SH’s son, MAH. Plaintiffs allege that had the first paramedics team transported SH to the hospital to undergo an immediate C-Section, MAH would have been minimally impaired, if at all.

10/27/2021JESSE PELAEZ, ET AL. v. CITY OF LOS ANGELES, ET AL. LASC Case No. BC721774 Family members of a woman killed in a police shooting after she was taken hostage at a homeless outreach center in June said they were filing wrongful death and negligence claims against the city of Los Angeles and the Los Angeles Police Department on Wednesday. Attorneys for three of Elizabeth Tollison’s adult children said they believed the LAPD officers who responded to Hope of the Valley Rescue Mission in Van Nuys after a report of a stabbing were negligent when they failed to de-escalate the situation, then fired their weapons 18 times at the man holding a knife to the woman’s neck. The 49-year-old Tollison was shot twice in the encounter, LAPD Chief Michel Moore said Tuesday. She was taken to a hospital, where she later died. Brian Dunn, a managing partner for the Cochran Firm, which is representing Tollison’s family, said the firing of that many rounds by officers was a “complete departure” from the department’s training for hostage situations. “It is illogical and inconceivable for an officer on the scene to not realize that she will certainly be shot if 18 rounds are fired,” Dunn said. LAPD released video of the encounter at its downtown headquarters on Tuesday. Chief Moore said he and investigators would review whether the officers followed training when they fired their weapons at Perez. Moore would not say Tuesday whether he believed the officers followed LAPD policy. But he said all officers are also trained in taking “precise head shots” in situations where a suspect has grabbed a victim to use as a human shield. And he noted that similar situations have been resolved in the past through an officer accurately shooting a hostage-taker.

BC 704465 - The City and DOES 1-10 allowed LAPD Officer Robert Cain to abuse his authority to sexually assault and committ lewd acts upon a minor enrolled in the LAPD Cadet Program at 77th Street. Officer Cain was appointed as Cadet Advisor despite previously being transferred from the Van Nuys Division because of a conduct complaint. Officer Cain's unusual interest and time spent "grooming" the minor went ignored and there was an attempt to hide and conceal the misconduct by failing to report to Child Protective Services, and to notify other minors in the cadet program, parents, or the community. Settlement for irreparable damages including: Negligence, Negligent Infliction of Emotional Distress, Sexual Harassment, Violation of Ralph Act-Civil Code 51.7, Violation of Bane Act-Civil Code 52.1.

12/10/2021TAMERIN LEWIS, ET AL. V. CITY OF LOS ANGELES, ET AL. LOS ANGELES SUPERIOR COURT CASE NO. BC 645185 - Plaintiff Keysonna Yvette Bursey, by and through her guardian ad litem, Tamerin Lewis (“Plaintiff”) initiated this wrongful death action on December 30, 2016 against Defendants City of Los Angeles (the “City”), Los Angeles Police Department (the “LAPD”), and Officer Charles Kumlander (“Kumlander”). The operative Second Amended Complaint (“SAC”) asserts causes of action for wrongful death (assault and battery), wrongful death (negligence), violation of the Ralph Civil Rights Act (Civil Code section 51.7), and violation of the Banes Civil Rights Act (Civil Code section 52.3). Plaintiff alleges that while decedent Keith Myron Bursey was a passenger in a parked vehicle, Kumlander ordered Mr. Bursey to exit the vehicle. When Mr. Bursey attempted to flee on foot, Kumlander drew his weapon and fired several shots into Mr. Bursey’s back, mortally wounding him. (SAC, ¶¶ 9-24.) Mr. Bursey was Plaintiff’s father. (SAC, ¶ 4.)

USDC Case No. CV18-03248-CAS-(JPRx) - Charged as a civil rights violation, LAPD used excessive force while responding to a roommate dispute. 20 year old Santino Cesar Cortez was shot several times and killed by LAPD who alleged he had drawn a gun. His mother Ann Janette Cortez was the plaintiff on behalf of her deceased son. SUBJECT TO THE APPROVAL OF THE MAYOR: 1. 7/22/2021TYLER SHEAR, ET AL. V. CITY OF LOS ANGELES, ET AL. LOS ANGELES SUPERIOR COURT CASE NO. BC 702166- Plaintiffs Tyler Shear, Tanner Shear, and Alexandria Shear (“Plaintiffs”) allege that Damon Shear (the “Decedent”) was a pedestrian at the intersection of Pacific Avenue and Sunset Avenue within the City of Los Angeles when he was struck and killed by a vehicle driven by Yvon Chausseblanche. (Trellis.Law) The intersection has been the scene of serious collisions previously, and in recent years the City of Los Angeles has increased LAPD presence there to target unsafe driving behaviors around this intersection, and LADOT has installed “paddles” in the crosswalk to alert drivers to the presence of pedestrians crossing, and has updated markings approaching the crosswalk so they are more visible. Additionally, to help pedestrians cross more safely, the City applied for and Caltrans awarded federal money to add flashing beacons and ADA-compliant access ramps at the intersection — but Caltrans has yet to actually give the money to LADOT. (The money is part of a master grant for several dozen intersections citywide, many with extensive federal requirements, including environmental clearances and additional levels of review, and Caltrans will not award the money until it has reviewed, approved and cleared all 36 projects.)

This case exemplifies the occurrence of excessive force by law enforcement during lawful and peaceful protest and in this case our client suffered serious and permanent injury as a result of lawfully protesting.

3/25/2022MAC SHORTY v. CITY OF LOS ANGELES, ET AL USDC CASE NO.: CV19-09355 DSF (KSx) - On October 31, 2017, Shorty was detailed to provide security at a church event Halloween party organized by his employer there was an incident and police were called. Shorty identified himself as a security officer for the church. Other members of the congregation who were present also identified Shorty as the church's security officer. While in full compliance with all the Police Officers' commands, the Officers without any warning started tasing Shorty. They deployed their taser a minimum of three to four times. The impact of the taser threw Shorty to the ground, causing him to hit his head and shoulder on the street curb, all to his injuries. The paramedics were summoned who took Shorty to the Hospital for his injuries. Thereafter, the Police Officers arrested Shorty and subsequently released him without any charges. Following his release. Shorty filed a complaint with the Internal Affairs of the Police Department. When Shorty requested the outcome of the Internal Affairs investigation, the Police Department refused to give him any documents.

1/12/2022CHRISTAL JOHNSON, ET AL. V. CITY OF LOS ANGELES, ET AL. UNITED STATES DISTRICT COURT CASE NO. CV20-05715 RGK (SHK)- May 13, 2018, incident. Defendants are Sergeant Cory Meisner and Officer Brandon Bolen. Christal Johnson filed a joint lawsuit on behalf of at least one of minors. Four teens were out partying, two were shot by strangers. The two teens who were shot were shackled, restrained and hogtied by LAPD after shooting, allegation is they died because LAPD did not provide timely assistance. Handcuffing interfered with EMT medical care. The other two Teens who were not shot later returned to the scene and were briefly arrested by LAPD officers. Mariyon Williams (one of the two minors that survived but was later briefly arrested) received $75k settlement as part of the second set of arrests.
